Terms and Conditions

These Terms govern your access to, usage of all content, Product and Services available at https://shop.impulse9.pro website (the “Service”) operated by impulse9 Kamil Stolorz (“us”, “we”, or “our”).

Your access to our services are subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.

Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.

Intellectual Property

The Agreement does not transfer from Us to you any of Ours or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with impulse9 Kamil Stolorz and its licensors.

Third Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third Party Services”).

If you use any Third Party Services, you understand that:

  • Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services.
  • You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such web sites or services.

Accounts

Where use of any part of our Services requires an account, you agree to provide us with complete and accurate information when you register for an account.

You will be solely responsible and liable for any activity that occurs under your account. You are responsible for keeping your account information up-to-date and for keeping your password secure.

You are responsible for maintaining the security of your account that you use to access the Service. You shall not share or misuse your access credentials. You must notify us immediately of any unauthorized uses of your account or upon becoming aware of any other breach of security.

Termination

We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately.

If you wish to terminate the Agreement or your impulse9 Kamil Stolorz account, you may simply discontinue using our Services.

All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer

Our Services are provided “AS IS.” and “AS AVAILABLE” basis. impulse9 Kamil Stolorz and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither impulse9 Kamil Stolorz, nor its suppliers and licensors, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of Poland.

The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in Poland.

Changes

impulse9 Kamil Stolorz reserves the right, at our sole discretion, to modify or replace these Terms at any time.

If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.

If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.

Your continued use of our Services will be subject to the new terms.

§ 1

GENERAL PROVISIONS

  1. The online store www.shop.impulse9.pro operates under the rules set out in these Terms and Conditions.

  2. These Terms and Conditions define the conditions for concluding and terminating Sales Agreements for Products, the procedure for complaints, as well as the types and scope of services provided electronically by the Store, the rules for providing such services, and the terms for concluding and terminating agreements for electronic services.

  3. Each User, upon taking any action to use the Store’s Electronic Services, is obliged to comply with these Terms and Conditions.

  4. Matters not regulated in these Terms and Conditions are governed by the following legal acts:

    1. The Act on Providing Electronic Services of 18 July 2002,

    2. The Consumer Rights Act of 30 May 2014,

    3. The Act on Out-of-Court Settlement of Consumer Disputes of 23 September 2016,

    4. The Civil Code of 23 April 1964, and other relevant provisions of Polish law.

  5. The online store strives to ensure full digital accessibility for all users in accordance with the European Accessibility Act (EAA) of 28 June 2015. In case of accessibility issues, Customers may send feedback via email: [email protected].


§ 2

DEFINITIONS USED IN THE TERMS AND CONDITIONS

  1. ORDER FORM – a form available on www.shop.impulse9.pro that allows the Customer to place an Order.

  2. CUSTOMER – a User who intends to conclude or has concluded a Sales Agreement with the Seller.

  3. CONSUMER – a natural person who performs a legal action with an entrepreneur that is not directly related to their business or professional activity.

  4. ENTREPRENEUR – a natural person, legal person, or organizational unit without legal personality, with legal capacity, conducting business or professional activity on their own behalf.

  5. ENTREPRENEUR WITH CONSUMER RIGHTS – a natural person entering into a contract related to their business activity where the agreement does not have a professional nature for that person.

  6. PRODUCT – a movable item available in the Store and subject to a Sales Agreement between the Customer and the Seller.

  7. TERMS AND CONDITIONS – these Terms and Conditions of the Store.

  8. STORE – the online store operated by the Service Provider at www.shop.impulse9.pro.

  10. SALES AGREEMENT – a contract for the sale of a Product concluded between the Customer and the Seller via the Store.

  11. ORDER – a declaration of intent by the Customer to conclude a Sales Agreement with the Seller.

  12. PRICE – the monetary value the Customer must pay the Seller for the Product.


§ 3

PRODUCT INFORMATION AND ORDERING

  1. The Store sells Products via the Internet.

  2. Products offered are new, free from defects, comply with the agreement, manufactured by the Seller, and legally introduced to the market in Poland.

  3. Information on the Store’s pages does not constitute an offer under the Civil Code but an invitation to conclude a contract. Placing an Order constitutes an offer to conclude a Sales Agreement on the terms specified in the Product description and these Terms and Conditions.

  4. Product prices are displayed in euros (EUR) and include all applicable taxes.

    • If payment in Polish zloty (PLN) is available, the payable amount may be converted from EUR according to the rules presented to the Customer during the Order process.

    • The Seller may offer discounts depending on the payment method. Discount information is provided to the Customer before placing the Order.

    • Prices do not include delivery costs, which are indicated to the Customer before placing the Order.

  5. Orders can be placed via the website www.shop.impulse9.pro 24/7.

  6. To place an Order, the Customer must read and accept the Terms and Conditions during the Order process.

  7. If a Product price is reduced, the Seller also provides information about the lowest price of the Product in the 30 days preceding the discount.

  8. If the Product has been offered for less than 30 days, the lowest price from the start of the offer to the discount date is provided.


§ 4

CONCLUDING A SALES AGREEMENT

  1. To conclude a Sales Agreement, the Customer must first place an Order using the method provided by the Seller, according to §3 points 5 and 6.

  2. Upon receiving the Order, the Seller immediately confirms its receipt electronically.

  3. Confirmation of Order receipt binds the Customer to the Order. Confirmation is sent via email.

  4. The Order confirmation contains:

    1. confirmation of all essential elements of the Order,

    2. withdrawal form,

    3. these Terms and Conditions, including information on the right of withdrawal.

  5. Upon receiving the email referred to in point 4, a Sales Agreement is concluded unless the Terms or Seller specify a different time for made-to-order or limited-quantity products.

  6. Every Sales Agreement is confirmed with an electronic proof of purchase (invoice) sent to the Customer’s email provided in the Order.


§ 5

PAYMENT METHODS

  1. The Seller provides the following payment methods:

      • The order number must be included in the transfer title.

    2. Payment via the Przelewy24 system (PAYPRO S.A.), allowing:

      • Card payment in EUR or PLN,

      • BLIK payment in PLN only.

  2. For bank transfers, the Customer pays to the account corresponding to the currency of the Order.

  3. For Przelewy24 payments, the payment must be made before order processing.
    The operator of payment cards is PayPro S.A. Settlement Agent, ul. Pastelowa 8, 60-198 Poznań, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number 0000347935, NIP 7792369887, REGON 301345068.

  4. Payment must be made within 3 business days of concluding the Sales Agreement, unless the Agreement specifies otherwise.

  5. Products are shipped only after payment is received.


§ 6

DELIVERY COSTS, TIME, AND METHODS

  1. Delivery costs are borne by the Customer and are indicated during the Order process.

  2. Delivery time includes order preparation and shipping time:

    1. Preparation takes 5 business days; for backorders, this may be longer. Customers are informed of estimated shipping times immediately.

    2. Shipping by carrier occurs within the timeframe specified by the carrier:

      • Domestic (Poland): ~10 business days excluding weekends and holidays,

      • EU: longer, specified during ordering,

      • Non-EU: depends on the carrier and customs procedures.

    • The Seller is not responsible for delays caused by the carrier or customs.

  3. Products can be shipped:

    1. Within Poland,

    2. To selected EU countries (list available in Store),

    3. Outside the EU (all customs, import taxes, or fees are borne by the Customer).

  4. Products are shipped from the Seller’s dispatch warehouse located at:

    The dispatch warehouse is the location where orders are processed and
    Products are prepared for shipment.

§ 7

PRODUCT COMPLAINTS

  1. Liability for lack of conformity:

    1. The Seller is liable to Consumers or Entrepreneurs with consumer rights for non-conformity under the Consumer Rights Act.

    2. Liability applies for 2 years from delivery, unless the Product’s expiration date is longer.

  2. Complaints can be submitted:

  3. The complaint should include Customer identification, description of non-conformity, and requested action.

  4. The Customer must provide the Product for inspection; the Seller covers return shipping costs.

  5. Complaints are handled within 14 days of receipt.

  6. Lack of response within 14 days constitutes acceptance of the complaint.

  7. If accepted, the Seller will repair, replace, reduce the price, or refund the Product within 14 days.


§ 8

RIGHT OF WITHDRAWAL

  1. Consumers may withdraw from a distance contract within 14 days without giving reasons, unless specified in point 10.

  2. The Product must be returned within 14 days to:

  3. Consumers are liable for diminished value due to excessive use.

  4. Refunds are made using the original payment method within 14 days of receiving the withdrawal notice or Product.

  5. Additional shipping costs for faster delivery are not refunded.

  6. Right of withdrawal does not apply to customized or personalized products.

  7. Both the Seller and the Customer may withdraw if the other party fails to meet obligations on time.

§ 9

TYPE AND SCOPE OF ELECTRONIC SERVICES

  1. The Store allows using electronic services to conclude Sales Agreements.

  2. Services are provided according to these Terms.

  3. The Store may display advertisements as an integral part of the website.


§ 10

TERMS FOR PROVIDING AND CONCLUDING ELECTRONIC SERVICE AGREEMENTS

  1. Electronic services are free of charge.

  2. The service agreement is concluded for a fixed period and ends when the Customer places or stops placing Orders.

  3. Technical requirements:

    1. Computer or mobile device with Internet,

    2. Email access,

    3. Web browser,

    4. Cookies and Javascript enabled.

  4. Users must comply with the law and respect intellectual property.

  5. Users must provide accurate data.

  6. Users may not submit illegal content.


§ 11

COMPLAINTS RELATED TO ELECTRONIC SERVICES

  2. The complaint should include details, including type, date of issue, and contact information.

  3. Complaints are handled within 14 days.

  4. Replies are sent to the email provided in the complaint.

§ 14

CHANGES TO TERMS AND CONDITIONS

  1. The Seller reserves the right to amend these Terms.

  2. Changes are published on the website and become effective at least 7 days after publication.

  3. Customers must review the current Terms before ordering.

  4. Continued use of the Store constitutes acceptance of the new Terms.


§ 15

FINAL PROVISIONS

  1. Agreements concluded via the Store are governed by Polish law.

  2. If any part of the Terms is invalid, applicable Polish law applies.

  3. Disputes with Consumers are first addressed through negotiation and alternative dispute resolution.

  4. Court jurisdiction follows the Civil Procedure Code.
